Terms of Service

Last updated: 24 August 2026

These terms cover your use of ourhouse build. They're written to be read, not to be impenetrable. If something here doesn't seem fair, email david@ourhousebuild.com.au and say so.

What the service is

ourhouse build is a record-keeping and tracking tool for people managing a residential build. It helps you keep your contract stages, budget, loans, compliance checklist, site diary, photos and documents in one place.

What it is not

It is not legal, financial, building or regulatory advice, and it is not a substitute for your building contract, your state's legislation, or advice from a lawyer, building consultant, registered building surveyor or licensed inspector. Compliance checklists and stage definitions in the app are general starting points that vary by state and by contract. Always work from your own signed contract and your own state's requirements. Decisions about paying a progress claim, approving a variation or signing off a stage are yours.

Your account

You need an account and an active subscription to use the app. Keep your password to yourself — you're responsible for what happens under your login. Each build supports one owner plus one invited partner, each with their own separate login. You're responsible for what happens under any login on your build, including your partner's.

Subscription, trial and billing

  • New accounts get a 14-day free trial. A payment method is required to start it.
  • You are not charged during the trial. At the end of the 14 days your card is automatically charged for the plan you chose, and then at the start of each billing period after that.
  • The current price is shown before you enter payment details and on the signup screen, along with the date of the first charge.
  • You can cancel at any time from Settings → Account. There is no minimum term and no cancellation fee.
  • Cancelling stops future charges and keeps your access until the end of the period you've already paid for. We don't pro-rate part-months.
  • If we change the price we'll tell you by email before it applies to you, and you can cancel first.

What happens to your data if you cancel

When a subscription ends, files you uploaded — documents, plans, drawings, progress photos, mood board images and receipts — are permanently deleted from our servers and cannot be recovered. Your written records are retained in case you come back. Download anything you want to keep before you cancel, particularly your photo record and contracts. See the Privacy Policy for detail.

Acceptable use

Don't upload anything unlawful, don't upload other people's material without the right to, and don't try to break, overload or reverse-engineer the service. We can suspend an account that does.

Availability

We aim to keep the service running and backed up, but we don't promise uninterrupted availability. Maintenance and outages happen. Keep your own copies of anything critical — your building contract and certificates should never exist only here.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law, which cannot be excluded. Where our liability can lawfully be limited, it is limited to resupplying the service or refunding what you paid us in the previous 12 months. We are not liable for building costs, construction losses, disputes with your builder, or decisions you made using the app.

Ending it

You can stop at any time by cancelling. We can suspend or close an account that breaches these terms, and we'll tell you why if we do.

Changes and contact

If these terms change materially we'll update the date above and let you know by email. These terms are governed by the laws of Victoria, Australia. Questions: david@ourhousebuild.com.au.
